Further to our last update on the execution of the exit policy. we wish to inform our SpeakAsia community that we have finished analysing the results of the first test batch of payouts that were sent.  

We have identified certain roadblocks such as multiple claimants to the same panelist id or bank details not matching with the ones submitted at the time of applying for the exit policy, because of which not everyone got the remittance in their accounts.

We are at this moment addressing those issues and hope to have a resolution to them by the end of this month. Once we have the resolutions in place we will then send out a second batch of test payouts. On successful completion of this second batch we will commence the payout as per the exit policy. 

We understand that there are delays in the process. One of the main contributor to this delay is the fact that we have had to do all the transactions and checking manually as our old automated systems are still under the custody of EOW Mumbai Police. We appeal to all the SpeakAsians to remain patient and bear with us as we work feverishly towards attaining our goals.

I am amazed to see the marketing blog’s update, exactly after 1 month from their previous update now they are just informing us that they have finished analysing the results of the first test batch of payouts. While we all Speakasians are waiting for their Exit Payments instead of giving any particular dates or time for the payments, Now they  have started bragging about  their Second Test Batch. What bullshit is this?  How many test batches will they conduct before the actual Exit Payments? What’s the legitimacy of these test batches, even the First Test batch seems more like a fake activity as not even a single panelist has claimed to receive any such Exit payments. Speaksia’s First Test Batch payment exists only in Mobiclub articles else it’s fake. So, believing on another such batch is just impossible. Speakasia is again using their same old strategy of buying time by giving such useless vague updates. I can’t understand, while at the time of joining they didn’t even ask for an ID proof, collected Crores of Rupees and were issuing thousands of accounts per day but Now, when the time came to return Payments instead of refunding, they are just making excuses. Why? Speakasia better clear it yourself that you will not return us anything, so, we can take legal assistance in this issue rather than wasting our time on pursuing your fake updates.

Yes, Speakasia can easily pay us back. Now they are free to make payments and they can even disburse Rewards Points along with Exit Optioner’s Payment.

What happened to Writ Petition 383 in Supreme Court ?

  

On  19.9.2012,  the  writ  petition  was  disposed  of  as withdrawn.On the basis of this Court's order  an  amount  of US $ 10million has been deposited by the 4th respondent which is now  lying in a fixed deposit in UCO Bank, Supreme Court Compound.  We order that amount has to be returned to the Respondent No.4.

Why was the Writ Petition 383 disposed?

Supreme Court disposed the Writ Petition 383 because It ordered the Speakasiaonline.com to refund the money of the Panellists not only to the 115 petitioners but to all the Exit Option seekers as well. And with Co-operative intention, Speakasiaonline.com showed the same willingness to payback with the below promise in Writing. That’s why it was withdrawn.

 

“The company assures full cooperation with any agency or authority that has the jurisdiction on this situation and wishes to fulfill its commitment to refunding the subscription amounts to all those who have opted for the exit option of the company.”

What was the benefit of the Writ petition 383 disposal, to the Speakasiaonline?

After the disposal of Writ Petition 383, with the order of Supreme Court, they have finally acquired the following privileges- Access to Server and databases, no restrictions on payment, unfreezing of the freezed accounts and RBI Clearance on transactions etc.

Note: Privileges might be temporary and conditional.

As being an Exit Optioner, Should I pursue the court case dates?

No, you don’t need to pursue any Court Case dates anymore as we Exit seekers have already got our judgement in Supreme Court Writ 383 on 19^th September 2012.

Why Speakasiaonline taking so much time in executing Exit Option Payments?

I can’t say anything on this but the time they took on Verification of Panellists details is way too much. Speakasia started Exit Option on 5^th October 2012, and it’s almost 2 and half month passed since they started the Exit Option but still they couldn’t arrange a Single Payment till today. I don’t think taking this much of time is justifiable. According to the discussions held on various websites, it has been disclosed that there is a very less chance of receiving our money from Speakasia, probably no money because they didn’t had any such intention from the beginning. Speakasia didn’t start this Exit Option by choice but by the force of Supreme Court Order. Let’s see how they respond to Supreme Court Orders.

Why websites like MobiClub and AISPA always insist us to focus on Court Dates rather than on Exit Payments?

MobiClub and Aispa websites are run by Senior Panellists (acting as a Defacto Local Management) and these peoples are seriously involved in the Speaksiaonline Scam. They pretend themselves as Speakasiaonline’s Local Management and misguide the poor panellist by posting their fake Articles so, they can keep us busy on reading their fake articles and divert our mind on reading these useless cases like Anticipatory Bail Application (ABA.108312) of Ashok Bahirwani. Just use your brain and ask yourself what could be the relation between the Exit Payments and a bail application? Nothing.

Now they have started spreading this news “High Court Order Passed on 17-Dec-2012 that Next FINAL Hearing will take Place on 9-Jan-2013 i.e. Wednesday after Winter Holiday”

With this “FINAL hearing” word they again want to fool us that this Final Hearing will finish all the problems of Speakasiaonline but in actuality it’s just a Bail Application, even if they get succeed then it will only provide benefits to Mr. Ashok Bahirwani against his future arrests. So, what are you expecting to achieve from this Bail application ABA.108312? Have you noticed that how many “FINAL HEARINGS” have been already passed  in the past 1 and 8 months.

What is AISPA?

AISPA is an association formed for the Panellist’s rights; This is what they pretends to be but in actuality this association consists of Top Crook promoters of the Speakasia, who are seriously involved in this multi billion Scam. Some Popular AISPA Activities – Misguiding, Fooling, Playing with the emotions of the Poor Panellists, Abusing our Indian Law, Govt. Agencies & Court Systems and misleading the panellists to create crowd outside the Courts so as to create a second thought in the mind of judges and the Media. But we Speakasians don’t understand that these AISPA peoples are just misguiding us for their own good.

Most importantly, AISPA is funded and guided by Speakasiaonline’s Top Management itself. The best example is - AISPA President Melwyn Crasto, who had already been arrested, interrogated and jailed over his involvement in the scam (as a “prime promoter”) and the deposit of funds into his personal accounts from Speak Asia that he “could not explain” to the EOW and Now Ashok Bahirwani is being interrogated by EOW and he fears the arrest and jail interrogation that’s why he is seeking Anticipatory Bail. So, there are “No Heroes” out there who are fight for us.

I haven’t opted for Exit Option in First Batch, So, how much time do I need to wait for the Second Exit Option?

It seems the First Exit Option batch was just a fake activity itself. So, in common sense, there would not be any further batches in future. 

Why always EOW, Media, RBI, Govt. agencies and our Court Systems are blamed for all the mishap?

EOW (Economic Offense Wing):- is just an Investigation Agency who doesn’t register cases against companies itself. It was us (Speakasians) who registered the FIRs against Speakasiaonline.com and after FIRs it becomes the police duty to investigate in the reported Crimes. Now, EOW is just performing their duty and investigating the Speakasia Scam. And will soon submit their charge sheet in the High Court. By the way EOW’s Charge sheet will expose the Scam commited by Speakasia. Soon or later but truth can’t be concealed forever and One day we will realise that we were supporting a Fraud Company and were being fooled by the Same and that’s the truth for sure.

Why the delay in Charge Sheet submission?

Investigation of such a huge Scam which is spread all around the Country and in abroad as well, is not an easy task - Involvement of 100s of peoples belonging from different states, Tracing the chain of the scammed money, pursuing the fugitives, Master minds are still un caught, so, without their interrogation difficulty in investigation etc. And many more activities are being performed by EOW in investigation. So, this investigation may continue for next 1 or 2 years.

Media: - They are better known as Tale-tellers, so, don’t pay much attention to them, they show everything else except NEWS.  But in Speakasia case it seems they were hired by Speakasiaonline itself for creating such a mess and Legal hurdles and they succeed in their job. Look now, where is Speakasia? This is the way how PONZI schemes end- Circulate the money at the Begining and later on collect the money of last Joiners, Stop Payments, Use the strategy of buying time by making excuses in payments and Finally, pack your bags and run away in disguise with the money and just pretend that we are with you but indeed they aren’t. This is how Speakasiaonline Looted Two Countries- First Bangladesh and then India. It’s not just a huge scam but a huge loss to our Indian Economy as well because they took more than 2 thousand crores of INR outside the Country.

RBI: - As it was already cleared last year, through RTI that RBI didn’t freezed Speakasia’s payement gateway. It merely released a circular to Banks regarding Speaksia’s transaction. That’s all, there was some minor issues with Speakasia’s transactions and the Indian banks which they could have been easily fixed 1 and half years back but they didn’t because they were Cheaters from the beginning and they left the situation unsolved and kept on misguiding the panellists instead of fixing these issues. They didn’t do anything in the most important issue which was directly associated with Our Payments, in fact this is the situation they wanted to create with the help of Media’s Allegations and they succeed in the creation also because they didn’t want to pay the panellists and it became their all in one Excuse “We are forced and Indian Govt. is not letting us to make payments”. It’s an old strategy used to easily divert the people’s mind by giving them an Enemy (whom they already don’t like much) and buy their loyalty.

Government Agencies: - Speakasiaonline violated various rules and regulations in India, Henceforth, Govt. agencies are after Speakasia for the fines and the penalties.

Courts (Indian Law system):- Indian Courts, Yes it is well known for its Super Slow Speed and especially in Speakasia case, unless EOW submits its Charge sheet and completes its investigation till then nothing could be expected. So, thinking for judgement in near 1-2 years, seems impossible and may take more years than that. So, don’t expect too much in near future. 

Here Above, I have explained all the possible causes for the delay. Now it’s your decision, whom to blame.

Some Peoples are saying that Speakasia has no access to the Server and the database, so, how can they verify data and make payments?

If Speakasia didn’t had the Server Access then how did they created this link and uploaded the page on the Company’s Server: - www.speakasiaonline.com/services

Why AISPA website stopped giving updates after 16^th November 2012 and why Ashok Bahirwani moved to twitter?

I don’t know but there might be some possible answers:-

• Probably the lead Talented Script Writer of AISPA site- Mr. Ashok Bahirwani has got restraint order from EOW not to use/misguide the panellists through AISPA site. 
• Or EOW might have taken the custody of AISPA site also. Nobody knows. 
• This is I am damn sure that Mr. Ashok Bahirwani is busy writing poetry in tweeter and there I found Mr. Aman Azad also, who was bragging about some Indian Corruption but he forgot to look his face in the mirror before writing that.

What will be the expected time frame for the Business Restart and what could be the Business Model?

I can’t say anything about Business Restart But I am sure if there is any restart in future then the Business Model is going to be completely changed because Speakasia’s current business model is just a Scam and fake and it’s already been proved in the investigation that their Client database is 100% fake, So, how were they paying to the panellists? They were just circulating the money paid by the new joiner to the old ones. And money circulation and Ponzi schemes are banned in India, so, such business model will not be approved by ROC(Registrar of Companies) India.

What could be the new business Model of Speakasia if they seeks registration in India? It’s very easy to guess and that is Product marketing, all the panellist will end up doing marketing of Speakasia’s own brand-YUG(Chinese Goods) products in exchange for Rewards points and there will not be any cash payments after restart. Something like this will happen only, if Speakasia gets registration in India and restart its operation but according to current situation it seems impossible because Speakasia Top Management is dead now and they have already fled from India. So, nothing can be predicted now.

What should I do to recover my money?

Either sit here in internet and wait for your whole life or better approach your nearest High Courts and seek Lawyers advice in this issue, they will definitely help you in recovering your money through our law system. This way atleast you will have more chances of recovering your money rather than believing on fake updates provided by Aispa, marketing blog, Mobi Club, Omg71, Satyabachan, Aman Azad and many more peoples out there, who will always keep you busy on believing their fake articles and waste your time for years by the way they have already wasted our 1 yr and 8 months. So, it’s  your decision what to do now?
